Gifting or transferring equity in property or land requires a transfer to be drafted and signed by all parties and then registration with HM Land Registry. Whilst some transactions can be straight forward, that is not always the case. Transfers can also be complicated and potentially involve financial obligations like Stamp Duty Land Tax (SDLT). This calculation can vary based on the nature of the transaction and property value.

Before proceeding with a change of ownership you should understand all the implications. As well as legal advice we also suggest that you speak to an accountant as there may be tax implications to transferring property.

If the transfer is part of estate planning, we would also advise you speak to a member of our Probate Department who will be able to advise on the implications of transferring property.
